Right-of-Way
H.R. 2337, the Energy Policy Reform and Revitalization Act of 2007, was introduced by the Chairman of the House Natural Resources Committee. The bill seeks to sharply curtail the ability to obtain a right of way easement on Federal Lands for electricity transmission or pipelines facilities. Section 103 of HR 2337 would repeal Section 368 of the Energy Policy Act 2005 (EPAct) that directed the federal government to designate corridors for oil, gas, and hydrogen pipelines and electricity transmission and distribution facilities on Federal land in eleven Western States. H.R. 2337 would require a study of energy transmission and corridor needs and defer designation of energy corridors, pending completion of the study. Sec. 103 places significant limitations on what lands may be considered (within 1 mile of designated or otherwise identified by State or Federal law or any applicable Federal, State, or local government land use plan for recognition or protection of scenic, natural, cultural, or historic resources; within 1 mile of any place proposed for formal protection similar to that previously described; in a sensitive ecological area, including those designated as critical habitat under the ESA of 1973 or otherwise identified as sensitive or crucial habit by federal or state agencies).
