Joint Industry Coalition Supports Government Request For Stay in Nationwide Permitting Case

FOR IMMEDIATE RELEASE

WASHINGTON, May 18, 2020—A joint coalition including the American Gas Association (AGA), American Petroleum Institute (API), Association of Oil Pipe Lines (AOPL), Interstate Natural Gas Association of America (INGAA), and the National Rural Electric Cooperative Association (NRECA), filed an Emergency Motion with the Ninth Circuit U.S. Court of Appeals requesting a stay pending appeal in Northern Plains Resource Council v. U.S. Army Corps of Engineers. The Federal Government filed a similar Motion on May 13.

“We are disappointed in the recent decision from the U.S. District Court of Montana, which arbitrarily disallows the construction of new oil and gas pipelines from using Nationwide Permit 12, and are hopeful the request for a stay will be granted.

“As it currently stands, Judge Morris’ decision makes the fate of hundreds energy infrastructure projects uncertain, and could jeopardize good-paying, middle class sustaining jobs around the country – as well as the energy that working families, businesses and first responders rely on every day, that will be critical to our country’s economic recovery.”

The American Gas Association, founded in 1918, represents more than 200 local energy companies that deliver clean natural gas throughout the United States. There are more than 75 million residential, commercial and industrial natural gas customers in the U.S., of which 95 percent — more than 71 million customers — receive their gas from AGA members. Today, natural gas meets more than three-tenths of the United States' energy needs.

API represents all segments of America’s oil and natural gas industry. Its more than 600 members produce, process, and distribute most of the nation’s energy. The industry supports 10.9 million U.S. jobs and is backed by a growing grassroots movement of millions of Americans. API was formed in 1919 as a standards-setting organization. In its first 100 years, API has developed more than 700 standards to enhance operational and environmental safety, efficiency and sustainability.

AOPL represents liquids pipeline owners and operators transporting crude oil, petroleum products like gasoline, diesel, jet fuel, home heating oil and industrial products like propane and ethane.

INGAA represents the U.S. natural gas pipeline industry. INGAA’s members deliver clean, abundant, affordable natural gas throughout North America and operate approximately 200,000 miles of pipelines that serve as an indispensable link between natural gas producers and consumers.

The National Rural Electric Cooperative Association is the national trade association representing nearly 900 electric cooperatives. From growing suburbs to remote farming communities, electric co-ops serve as economic engines for 42 million Americans across 56 percent of the nation’s landscape. As local businesses built by the consumers they serve, electric cooperatives have meaningful ties to rural America and invest $12 billion annually in their communities.
