U.S. Army Corps of Engineers.
Joint Industry Coalition Supports Government Request For Stay in Nationwide Permitting Case

WASHINGTON, May 18, 2020—A joint coalition including the American Gas Association (AGA), American Petroleum Institute (API), Association of Oil Pipe Lines (AOPL), Interstate Natural Gas Association of America (INGAA), and the National Rural Electric Cooperative Association (NRECA), filed an Emergency Motion with the Ninth Circuit U.S. Court of Appeals requesting a stay pending appeal in Northern Plains Resource Council v. U.S. Army Corps of Engineers. The Federal Government filed a similar Motion on May 13.
“We are disappointed in the recent decision from the U.S. District Court of Montana, which arbitrarily disallows the construction of new oil and gas pipelines from using Nationwide Permit 12, and are hopeful the request for a stay will be granted.
“As it currently stands, Judge Morris’ decision makes the fate of hundreds energy infrastructure projects uncertain, and could jeopardize good-paying, middle class sustaining jobs around the country – as well as the energy that working families, businesses and first responders rely on every day, that will be critical to our country’s economic recovery.”
